ToysAndGames.be delivers products and services through their website www.ToysAndGames.be.
ToysAndGames.be offers their products according to the conditions described in these general terms and conditions.
These general conditions apply to any order of products on the website of ToysAndGames.be.
Consumer, means any physical or legal person who acquires or uses for an nonprofessional purpose, products or services presented on the website. As a consumer, the customer has specific rights, which would be denied in the occurence that the products or services acquired through the website would actually concerned to his professional activity.
Pofessional means anyone who does not fit the definition of consumer given above.
We offer a wide range of products. Read these conditions carefully before you place an order on ToysAndGames.be. Any order for a product of the website ToysAndGames.be, implies acceptance of all these terms and conditions.
1. HOW TO ORDER
If you want to buy one or more products on the site, you need to select each product you want to buy and add it to your shopping cart. Once you have selected all the products you want to buy, you can confirm the contents of your shopping cart and place the order.
At this point, you will be redirected to a page that gives you a summary of the products you have selected, their price with or without shipping costs, determined according to the terms of free delivery. You will then have to choose the payment method that suits you best.
After placing your order, we will send you a confirmation email. We will inform you about the preparation and an indicative delivery time of your items.
Please note that we only sell products in quantities that meet the usual average needs of a household. This applies both to the number of products ordered in a single order and to the number of individual orders, taking into account the usual volume of a normal household placed for the same product. ToysAndGames.be may also refuse orders if it appears that the buyer wants to resell the products (we are not selling to shops).
You agree to receive the invoices for your purchases electronically. Electronic invoices will be sent to you in pdf-format. For the request of your invoice or for more information, please contact us by using our form.
2. OWNERSHIP TRANSFER
The delivered products remain the property of ToysAndGames until they are handed over to the carrier.
3. 14 DAYS RIGHT OF WITHDRAWAL, EXCEPTIONS TO THE RIGHT OF WITHDRAWAL, OUR RETURN POLICY OF 30 DAYS.
RENUNCIATION RIGHT
Unless one of the following exceptions applies, the consumer has the right to notify the seller that he renounces to his order without penalty and without giving any reason, within 14 working days from the day after the product delivery.
It's strongly recommended that returned products to TOYSANDGAMES are in perfect condition for resale in their original condition (packaging, accessories, manuals), sealed, and with a copy of the invoice or delivery within 14 days. Any product incomplete, damaged or in a demaged original packaging, will not be refunded or exchanged.
Consumers wishing to exercise this right should contact us within 14 working days, from the date on which you or a third party designated by you (other than the carrier) physically took possession of the goods purchased, via our contact form on the site, by e-mail or by post.

CONSEQUENCES OF REVOCATION
We will refund you the full amount of your purchase, including shipping costs, no later than 14 days after receipt of your cancellation request. We may postpone the refund until we have received the products. If the refund is made after the above deadline, the amount due to you will not be increased.
We will refund the amount to the same account that was used to make the payment.
Please note that you must return the product(s) no later than 14 days after the date you notify us of your cancellation decision.
The cost of returning the goods will not be reimbursed.
If the returned product is in one way or another reduced in value, ToysAndGames reserves the right to hold the customer liable and to demand compensation for any reduction in value of the goods resulting from the use of the goods by the customer that goes beyond what is necessary to determine the nature, the characteristics and the functioning of the goods.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply to:
The supply of products that cannot be returned for reasons of hygiene or health protection, if you have opened them or have inseparably mixed them with other items after delivery.
You also benefit from the legal warranties of conformity and hidden defects as stated in article 7 of these General Conditions of Sale ("Our Responsibility Guarantees").
4. PRICE AND AVAILABILITY
All prices include all Belgian taxes (Belgian VAT and other applicable taxes) unless otherwise indicated.
The availability of the products we sell on the website is shown on each product sheet. We cannot provide any further details regarding the quantity of the products.
When processing your order, we will notify you as soon as possible by e-mail to the appropriate address, if the products ordered by you turn out to be unavailable, and we will not charge you for these products.
Despite our efforts, a small number of the products in our catalogue may show a price error. We will check the price at the time of processing your order and before any payment. If it appears that we have made a mistake in displaying the price and that the actual price is higher than the price shown on the website, we may contact you to ask you if you wish to purchase the product at the actual price or if you wish to cancel your order. If the actual price is lower than the stated price, we will charge you the lowest amount and send you the product.
5. CUSTOM DUTY
When you order products from ToysAndGames.be for delivery outside the European Union you are considered as the authorized importer and as such you must respect the laws and regulations of the country in which you take delivery of the goods. You may be subject to fees or duties to the arrival of the goods in your country.
All additional customs' fees are your own responsibility. ToysAndGames has no control over these charges and does not know the amount. Customs policies vary by country, you should contact your local customs' department for more information.
Protecting your privacy is important to us and we draw the attention of our international customers to the fact that cross-border deliveries are likely to be opened and controlled by customs.
6. ORDERING ON THE WEB
Ordering on the web is the fastest and easiest way to order products safely. If you are using a public or shared computer, we strongly recommend that you log out after each use.
7. OUR RESPONSIBILITY - GUARANTEES

Except from deliveries in Belgium, the Netherlands, France and Luxembourg, we reject any liability in the event that the delivered item does not comply with the legislation of the country of delivery.
We are not liable in case of delay due to a stock shortage at the publisher or supplier. In addition, we are not liable for small differences between the presentation pictures of the articles and texts on the website www.ToysAndGames.be and the delivered products.
We use all means at our disposal to ensure the services of these general terms and conditions of sale. We are liable for all direct and foreseeable damages at the time of use of the website or the conclusion of the sales between us and you. In the context of our relationship with professionals, we are not liable for loss of profit, loss of business, loss of data or shortages or other indirect or unforeseeable damage at the time of the use of the website or the conclusion of the sales between us and you.
The above mentioned liability does not apply in case of fraud or gross negligence on your part, in case of personal injury, in case of evacuation and in case of non-compliance.
8. APPLICABLE LAW
These terms and conditions of sale are subject to the Belgian law. You undertake to submit all disputes arising from the commercial relationship between you and us to the non-exclusive jurisdiction of the Belgian courts, which means that, for the purposes of these general terms and conditions of sale, you may bring an action to enforce your consumer rights in Belgium. If you are a consumer and your habitual residence is in a country of the European Union, you also enjoy rights that protect you under the mandatory provisions of the law applicable in your country of residence.
9. MODIFICATION OF SERVICE OR OF THE GENERAL TERMS AND CONDITIONS OF SALE
We reserve the right to make changes to our website, our procedures and our general terms and conditions of sale at any time. You will be subject to the procedures and terms and conditions of sale at the time you order a product from us, unless a change to these terms and conditions is required by an administrative or governmental authority (in which case such change may apply to previous orders you have placed). In case any provision in this agreement shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
10. INSURANCE
If you violate these terms and conditions and we take no action, we still have the right to use our rights and remedies in any other situation in which you violate these terms and conditions.
11. MINORY
We do not sell products to minors. We sell children's products for adult purchases. If you are under the age of 18, you may only use the www.ToysAndGames.eu website under the supervision of a parent or guardian.
